This Acceptable Use Policy (“AUP”) governs access to and use of all products, software, hosting, APIs, and digital services (collectively, the “Services”) provided by Webstellation (“we”, “us”, or “our”).
This AUP is designed to protect Webstellation, our clients, end-users, and the broader internet community from illegal, unethical, or harmful activities. It applies to all customers and any third party accessing our Services through a customer account (“End-Users”).
By accessing or using our Services, you agree to comply with this AUP and ensure compliance by your End-Users.
1. Fair Use and Resource Management
Our Services are provided for standard business operations as outlined in your specific service agreement.
- Excessive Usage: If your resource consumption (including bandwidth, CPU, storage, or API calls) significantly exceeds normal operating parameters or degrades platform stability for other clients, we reserve the right to throttle performance, request infrastructure optimization, or apply additional operational fees.
- Service Limits: Circumventing rate limits, quotas, or technical restrictions embedded within the Services is strictly prohibited.
2. Customer Accountability and Security Obligations
Customers are fully responsible for all activity originating from their accounts or infrastructure.
- Security Safeguards: You must implement commercially reasonable security measures (including strong access controls, multi-factor authentication, and software patching) to prevent unauthorized access.
- End-User Compliance: You are responsible for ensuring that your End-Users adhere to this AUP. Breaches committed by your End-Users will be treated as breaches by you.
- Prompt Notification: You must notify us immediately at security@webstellation.com if you detect or suspect any unauthorized access, account compromise, or security incident relating to our Services.
3. Prohibited Activities
You may not use, nor permit others to use, our Services for any of the following prohibited purposes:
A. Illegal and Infringing Content
- Intellectual Property Infringement: Uploading, hosting, distributing, or linking to content that infringes copyrights, trademarks, patents, trade secrets, or proprietary rights.
- Child Exploitation and Violent Material: Hosting or transmitting Child Sexual Abuse Material (CSAM), non-consensual sexual content, terrorism-related content, or material inciting violence.
- Defamation and Hate Speech: Publishing content that promotes illegal discrimination, violence, harassment, or hatred against protected groups or individuals under EU and Member State law.
B. Network Abuse and Cyber Attacks
- Unauthorized Access: Gaining or attempting to gain unauthorized access to accounts, servers, networks, or data (“hacking”, credential stuffing, or packet spoofing).
- Service Disruption: Launching or facilitating Denial-of-Service (DoS/DDoS) attacks, network sniffing, mail-bombing, or traffic flooding.
- Malicious Code: Intentionally or recklessly deploying viruses, ransomware, trojans, spyware, or malicious scripts.
- Vulnerability Scanning: Performing security scans, penetration testing, or vulnerability probing against our infrastructure without prior written authorization from Webstellation.
C. Spam and Unsolicited Messaging
- Unsolicited Bulk Messages: Transmitting unsolicited commercial communications (“spam”) in violation of EU ePrivacy laws and applicable national legislation.
- Unconfirmed Lists: Operating email or contact lists that do not utilize confirmed opt-in (double opt-in) consent mechanisms.
- Third-Party Lists: Using purchased, rented, or scraped contact databases for promotional communications.
D. Automated Scraping and AI Misuse (EU AI Act & Data Safeguards)
- Data Scraping and Mining: Utilizing automated tools, bots, or crawlers to extract data, text, or source code from our platform for training artificial intelligence models or public datasets without express written authorization.
- Deceptive AI Deployments: Deploying AI systems through our platform in violation of the EU AI Act (Regulation (EU) 2024/1689), including generating deepfakes without disclosure, automated impersonation, phishing campaigns, or illegal social engineering schemes.
E. Fraud and Brand Impersonation
- Phishing and Fraud: Operating deceptive pages, fake storefronts, or credential harvesting schemes.
- Impersonation: Falsely claiming an affiliation with Webstellation, misrepresenting ownership of our brand assets, or forging header information to disguise message origin.
4. Digital Services Act (DSA) and Content Moderation Procedures
In accordance with the EU Digital Services Act (Regulation (EU) 2022/2065):
Notice and Action Mechanism
If any individual or entity believes that content hosted on or transmitted through our Services is illegal under EU or Member State law, they may submit a notice to terms@webstellation.com. Notices must contain:
- A clear statement explaining why the content is alleged to be illegal.
- The precise URL or technical location of the material.
- The name and email address of the submitter.
Moderation Actions and Statement of Reasons
If we detect or receive notice of a violation of this AUP or applicable law, we may take appropriate remedial actions, including:
- Issuing a formal warning.
- Temporarily disabling access to or removing specific non-compliant content.
- Suspending or terminating account access.
When taking such actions, we will provide the affected customer with a Statement of Reasons detailing the legal or contractual grounds for the action, unless restricted by law enforcement orders.
Internal Complaint System
Customers whose content or accounts have been restricted or suspended under this policy have the right to lodge an internal appeal within 6 months of the decision by contacting terms@webstellation.com. Appeals will be reviewed by trained personnel without sole reliance on automated tools.
5. Reporting and Legal Enforcement
In severe cases involving illegal acts (such as CSAM, cybercrime attacks, terrorism, or direct threats to health and safety), Webstellation reserves the right to report relevant account information and diagnostic logs to law enforcement or supervisory authorities in accordance with EU and national laws.
6. Amendments to This Policy
We reserve the right to revise this AUP to reflect changes in legal requirements, security standards, or service offerings. Revised versions will be published on our website with an updated “Last Updated” date. Continued use of our Services following the publication of an update constitutes acceptance of the revised AUP.
